OFFROAD USE ONLY
In order to purchase products from Nosta, the buyer is required to check the ‘Terms and Conditions’ box acknowledging that they have read, acknowledged, and understood the below.
Unless otherwise noted, ALL products sold from Nosta are sold with the sole intention for off road or racetrack use only. Products may not comply with some State, Federal, Provincial and/or Local laws, ordinances, regulations or emissions standards.
The buyer takes full responsibility for the use of these products on their automobile which may or may not conform to all applicable laws and regulations for on road or highway use.
The buyer acknowledges that Nosta has made them aware that these products are intended for off road or racetrack use only.
The buyer absolves Nosta from all responsibility in ensuring that his or her automobile is compliant with all State, Federal, Province, Local ordinances and emissions.
This waiver of compliance covers all past and future purchases from Nosta.
THESE PARTS ARE LEGAL FOR USE ONLY IN COMPETITION RACING VEHICLES AS DEFINED UNDER THE LAW OF THE STATE OF CALIFORNIA AND ARE NOT LEGAL FOR USE IN ANY OTHER MOTOR VEHICLE OR CAPACITY. These parts may only be used on competition racing vehicles operated exclusively on a closed course in conjunction with a sanctioned racing event. Competition-only motor vehicles may not be driven to a racing event on a public highway and must be transported on a trailer or other carrier. USE OF THESE PARTS IN ANY OTHER VEHICLE MAY SUBJECT YOU TO FINES AND PENALTIES FOR VIOLATION OF FEDERAL AND/OR STATE LAW, WILL VOID YOUR WARRANTY FROM Nosta, AND CAN VOID YOUR VEHICLE'S WARRANTY. It is your responsibility to comply with all applicable federal and state laws relating to use of these parts, and Nosta hereby disclaims any liability resulting from the failure to use these parts in compliance with all applicable federal and state laws.
SITE DISCLAIMER AND TERMS OF USE AGREEMENT
PLEASE READ THIS DOCUMENT CAREFULLY BEFORE ACCESSING OR USING THE SITE. BY ACCESSINGING OR USING THE SITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH BELOW. YOU AGREE TO REVIEW THE AGREEMENT PERIODICALLY TO BE AWARE OF SUCH MODIFICATIONS AND YOUR CONTINUED ACCESS OR USE OF THE SITE SHALL BE DEEMED YOUR CONCLUSIVE ACCEPTANCE OF THE MODIFIED AGREEMENT.

This website (the “site”) is operated by Nosta LLC (“Nosta”). Throughout the site, the terms “we”, “us” and “our” refer to Nosta. Nosta offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

You may print and download portions of material from the different areas of the Site solely for your own non-commercial use provided that you agree not to change or delete any copyright or proprietary notices from the materials. You agree to grant to NOSTA a non-exclusive, royalty-free, worldwide, perpetual license, with the right to sub-license, to reproduce, distribute, transmit, create derivative works of, publicly display and publicly perform any materials and other information (including, without limitation, ideas contained therein for new or improved products and services) you submit to any public areas of the Site (such as comments and forums) or by e-mail to NOSTA by all means and in any media now known or hereafter developed. Publications, products, content or services referenced herein or on the Site are the exclusive trademarks or service marks of NOSTA. Other product and company names mentioned in the Site may be the trademarks of their respective owners.
3. Use of the Site
You understand that, except for information, products or services clearly identified as being supplied by NOSTA, NOSTA does not operate, control or endorse any information, products or services on the Internet in any way. Except for NOSTA- identified information, products or services, all information, products and services offered through the Site or on the Internet generally are offered by third parties that are not affiliated with NOSTA. You also understand that NOSTA cannot, and does not guarantee or warrant, that files available for downloading through the Site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

The provisions of paragraphs 2 (Use of the Service), and 3 (Indemnification) are for the benefit of NOSTA and its officers, directors, employees, agents, licensors, suppliers, and any third party information providers to the Service. This Agreement may be terminated by Nosta without notice at any time for any reason. The provisions of paragraphs 1 (Copyright, Licenses and Idea Submissions), 2 (Use of the Service), 3 (Indemnification), 4 (Third Party Rights) and 6 (Miscellaneous) shall survive any termination of this Agreement. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
18. SEVERABILITY]

Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. NOSTA’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. NOSTA may assign its rights and duties under this Agreement to any party at any time without notice to you.
